These Terms and Conditions (“Terms”) govern your access to and use of Hexia, including any related features, content, services, and in-app purchases. By downloading, installing, accessing, or using the app, you agree to be bound by these Terms and acknowledge that they form a legally binding agreement between you and us. If you do not agree, you must not use the app.
We may make the app available through different platforms or stores, and your use may also be subject to the applicable terms of those platforms. To the extent any platform terms conflict with these Terms, these Terms control for matters relating to your use of Hexia, unless the platform terms require otherwise.
Hexia, including its name, logos, designs, user interface, software, features, workflows, text, graphics, and other original materials, is owned by us or our licensors and is protected by applicable intellectual property laws. We reserve all rights not expressly granted to you in these Terms.
Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the app for your own lawful purposes. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or otherwise attempt to derive source code or underlying ideas from the app except to the extent such restrictions are prohibited by law.
You retain ownership of the content you create, upload, import, enter, or otherwise submit into the app, including flashcard text, tags, examples, and related notes (“User Content”). We do not claim ownership over your User Content.
To operate the app, you grant us a limited license to host, process, store, display, and transmit your User Content only as necessary to provide the app’s functions, including local storage, syncing-free processing where applicable, analytics-free app behavior, and generating your personal study results. This license is solely for the purpose of delivering the service to you and ends when your content is deleted from the app or when you stop using the app, except to the extent retention is required by law.
Hexia may generate study schedules, review intervals, statistics, reminders, quiz outcomes, progress indicators, and other automated outputs based on your inputs and local app logic. These outputs are provided for informational and organizational purposes only.
We do not guarantee that any generated result will be accurate, complete, current, or suitable for any particular purpose. Any reliance you place on the app’s automated recommendations or metrics is at your own risk, and you are responsible for independently verifying any information that matters to you.
You agree not to use Hexia in any way that is unlawful, harmful, abusive, deceptive, or otherwise inconsistent with these Terms. Prohibited conduct includes, without limitation: violating any applicable law or regulation; infringing intellectual property or privacy rights; submitting malicious, defamatory, harassing, obscene, or hateful content; attempting to access data you are not authorized to access; interfering with or disrupting the app’s operation; using bots, scripts, scrapers, or other automated means to misuse the service; and attempting to reverse engineer, bypass, or tamper with security or usage controls.
You may not use the app to store or distribute content that is illegal, exploits minors, encourages violence, or otherwise creates risk of harm to others. We may investigate suspected violations and take any action we deem appropriate, including restricting access or removing content where technically possible.
You must be at least 17 years old to use Hexia. By using the app, you represent and warrant that you are 17 or older and that you have the legal capacity to enter into these Terms.
If you use the app on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms. If you are not old enough or legally able to agree, you may not use the app.
To the maximum extent permitted by law, we and our affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the app, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from or relating to the app or these Terms will be limited to the amount you paid, if any, for the app or in-app purchases during the twelve months preceding the event giving rise to the claim, or the minimum amount permitted by law if greater. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Hexia is a local flashcard-based study and memory tool designed to help users review words, concepts, formulas, and other memorization materials using a spaced repetition approach. The app allows you to create decks, add and edit flashcards, import cards in bulk, review cards in a full-screen study mode, track your progress, and run quick quiz sessions. Review scheduling, progress tracking, streaks, and statistics are calculated on-device.
The app is designed to store your data locally on your device using system storage technologies. It does not require an internet connection for core study functionality. Hexia may also provide reminders, visual progress charts, study summaries, and related interface features intended to support personal learning.
Some features may depend on your device capabilities, operating system version, permissions you grant, or the availability of certain system services. Features, visual design, and workflow details may evolve over time as the app is updated.
The app is provided on an “as available” and “as is” basis for convenience. We do not guarantee that Hexia will be uninterrupted, error-free, secure, or available at all times, and we may modify, suspend, discontinue, or limit any feature or portion of the service at any time, with or without notice where permitted by law.
We are not responsible for delays, failures, or unavailability caused by device issues, operating system changes, third-party services, notification delivery limits, store policies, network conditions, or events beyond our reasonable control.
You may stop using Hexia at any time by uninstalling the app and ceasing access. Because the app is primarily local, removal of the app may also remove or make inaccessible data stored on your device, depending on your device settings and backup choices.
We may suspend or terminate your access to the app, in whole or in part, if we reasonably believe you have violated these Terms, if required by law, or if necessary to protect the app, other users, or our rights and interests. Sections that by their nature should survive termination will survive.
To the fullest extent permitted by law, Hexia is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and quiet enjoyment.
We do not warrant that the app will meet your expectations, produce any particular learning results, or operate without defects. Any study outcomes, memorization gains, or progress indicators are influenced by your own usage, inputs, and circumstances.
You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, contractors, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: your use of the app; your User Content; your violation of these Terms; your violation of any law or third-party right; or any misuse of the app under your account or device.
We reserve the right, at our option and expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with our defense of that claim.
Hexia may offer in-app purchases and a virtual coin system used to unlock or support certain app actions. Coins are virtual consumables, have no cash value, and do not constitute property, currency, or any stored monetary balance. They may only be used within the app as described at the time of purchase or grant.
All in-app purchases are processed through Apple’s payment systems, where applicable, and are subject to the terms and policies of the applicable app store. Except where required by law or the app store’s policies, purchases are final and non-refundable. We may modify coin pricing, coin usage rules, or purchase offerings at any time, provided that such changes will not retroactively affect rights already acquired in violation of applicable law.
We may update or revise these Terms from time to time to reflect changes in the app, legal requirements, or our business practices. When we do, we will post the revised Terms with an updated “Last updated” date or otherwise provide notice as required by law.
Your continued use of the app after the revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the app.
You are responsible for the accuracy, legality, and appropriateness of the content you add to Hexia. You should ensure that your flashcards, notes, tags, imported text, and other materials do not infringe the rights of others or violate any law.
You are also responsible for maintaining the security of your device, following any prompts for permissions, and backing up your own data if you wish to preserve it. Because many features are local to your device, loss, deletion, or device failure may result in permanent data loss. We are not responsible for recovering deleted local data unless required by law or expressly stated otherwise.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, and non-transferable license to access and use Hexia for your personal, non-commercial study and organization purposes. This permission does not give you ownership of the app or any of its intellectual property.
You may use the app on devices you control, create and manage your own study materials, and access the features made available to you, so long as you do so lawfully and in accordance with these Terms. Any use beyond this limited license requires our prior written permission unless otherwise allowed by law.
These Terms and any dispute or claim arising out of or relating to them or the app will be governed by and construed in accordance with the applicable laws, without regard to conflict-of-law principles, except where mandatory consumer protection or local law requires otherwise.
If a dispute cannot be resolved informally, it will be brought in the competent courts or other forums permitted by applicable law, unless a different venue is required by a mandatory legal rule.
